One of the most painful things we can ever experience is someone telling us we’re not good parents or guardians for our children. We always want the best for our children, but sometimes social services doesn’t agree with what we believe is good for the child.
The job of a social worker is to ensure the safety of every child in a home. If you or someone in your household has been reported to social services, you may have your child or children removed from the home. What can you do about this?
If your children are taken from the home and placed into the custody of social services, they have 48 hours in which to file a report against you on behalf of the children for domestic issues such as violence, truancy, substance abuse or other dangers to your kids. This gives the social worker two days in which to do a full investigation and research the matter, plus time to prepare the necessary documents needed for the court.
One of the things you may not know though is that a lot of the social workers misunderstand this rule and they think they have 72 hours, not the actual 48 hours. Whether it’s poor training or just a general lack of knowledge about the rules, in either case it means the social worker may make a mistake that benefits you and your family. If they fail to file the claim within the actual legal guidelines of 48 hours, an experienced attorney can point that out and may be able to get the judge to dismiss all the charges and petition against you.
